LEGAL INSIGHT TO THE GRANT AND REVOCATION OF PATENT IN NIGERIA

Abstract

This work focused on the legal rules guiding the administration of patents in Nigeria. It made a critical analysisof the complexities surrounding the grant of patents in Nigeria. In this wise, the various issues associated withdetermining what amounts to a patentable invention were examined in this work. Also, the procedure forregistration of patents in Nigeria as well as the grounds and procedure for challenging the registration of apatent were fully considered. This work found that the statutory framework for the administration of patents inNigeria is robust though involves a lot of technicalities which may pose clogs in the smooth running of thesystem. This work recommended periodic updates of the Patents and Designs Act and the adoption ofinternationally recognized best practices towards enhancing the state of patent administration in Nigeria.
