REGULATORY REGIME FOR SOLID ORGAN TRANSPLANTATION IN NIGERIA: A COMPARATIVE ANALYSIS*

Abstract


The right to health is an inclusive right that contains both freedoms and entitlements;1solid organ transplantation is a medical intervention that touches directly on the right to health of the donor and the recipient, therefore there is a need for an adequate and efficient framework to regulate solid organ transplantation. The Article undertook a critical appraisal of the provisions of the National Health Act 2014 on organ donation and transplantation and a comparison of these provisions to the Laws governing organ donation and transplantation in the UK and South Africa with the aim of bringing out the strength and weaknesses of the provisions of the National Health Act 2014 on the subject and offered recommendations for possible review.
