JUDGMENTS: COULD JUSTICE BE MISSING?

Abstract


The entire essence of law may be said to be justice. Justice in the simplest terms is fair treatment of people1.Judgment seeks to determine the rights (or wrongs) of parties according to law. The onerous task of decisionmaking embodied in judgments notwithstanding it is within the province of the judge so to do. The work attemptsa perusal of ‘behind the scene and judges’ mind’ before arriving at a decision. The concept of justice is furtherstretched beyond the bounds of judgment of the court. It was found that equality before the law is a myth affectedby the entire processes leading to judgment. This same myth is seen in varying degrees in the society. A just andfair administration of justice is of the essence if justice remains our focal point towards societal developments.
