ENVIRONMENTAL IMPACT ASSESSMENT AND SUSTAINABLE DEVELOPMENT: A REVIEW OF THE RE LEVANT NIGERIAN LEGAL FRAMEWORK
Abstract
Environmental impact assessment (EIA) is acrucial toolfor ensuring sustainable development by mitigating theadverse effects of projects on the environment. Thispaper provides a comprehensive review of the Nigerianlegal framework governing EIA and its implications forsustainable development. E mploying a doctrinal researchmethodology, the study examines key statutes such as theConstitution, the Environmental Impact Assessment Act,the Petroleum Industry Act, and the Minerals and MiningRegulation Act. Findings reveal significant challengeshin dering the effective implementation of EIA in Nigeria,including inadequate enforcement mechanisms,insufficient public participation, and gaps in the existinglegal framework. Recommendations are provided toenhance the effectiveness of the Nigerian legalframework for EIA, including strengthening enforcementmechanisms, enhancing public participation, andimproving coordination among relevant governmentagencies and stakeholders.
