IMPACT OF RELIGIOUS LAW AND CUSTOMARY LAW ON SOCIETAL DEVELOPMENT: THE AFRICAN NARRATIVE
Abstract
The impact of religious law and customary law on societal development in Africa is a complex and multifaceted phenomenon that varies across different regions, cultures, and historical contexts. This article discussed the impact of religious law and customary law on the development of Africa, focusing on how they have influenced various aspects such as governance, social cohesion, education, and economic development. In achieving this, the doctrinal research method was resorted to and data were collected through reference to both primary sources and secondary sources. It was found that religious law and customary law have profoundly shaped African societies. While they offer valuable contributions to social order, cultural identity, and moral values, they also present challenges regarding gender equality, human rights, and adaptation to a changing world. The ongoing development of African societies hinges on finding a balance that respects tradition while promoting progress, justice, and equality for all. African societies need to integrate religious and customary law to promote legal pluralism, access to justice, and cultural diversity while upholding human rights and social justice.
